Planning Proposal and Draft DCP Amendments: Detached Dual Occupancy Development

Consultation has concluded

Following a second public exhibition period held in mid 2018, on 26 July 2018 Council resolved to endorse the Planning Proposal (PP_2017_COFFS_004_00 ) to permit dual occupancy (detached) development with consent in the RU2 Rural Landscape Zone . The project also includes associated accompanying Development Control Plan (DCP) 2015 provisions. The Planning Proposal, which is comprised of Local Environmental Plan Amendment No. 13, applies to lands zoned RU2 Rural Landscape and facilitates dual occupancy (detached) by way of a proposed amendment to the written provisions of Coffs Harbour Local Environmental Plan (LEP) 2013.

Council forwarded the necessary Planning Proposal documentation

Council forwarded the necessary Planning Proposal documentation to the NSW Department of Planning and Environment to finalise the Planning Proposal process under Section 3.36 of the Environmental Planning and Assessment Act 1979. As a result, Local Environmental Plan Amendment No. 13 was notified on the NSW Government legislation website on Friday, 31 August 2018. As such the Local Environmental Plan Amendment process is complete and Council can now accept applications for detached dual occupancy development on land zoned RU2 Rural Landscape.

    b) be received by Council during the submission period; and
    c) be correctly or ‘properly’ made to include the proposal title and reasons for the submission.

    Council is committed to openness and transparency in its decision making processes.  The Government Information (Public Access) Act 2009 requires Council to provide public access to information held unless there are overriding public interest considerations against disclosure.  Any submissions received will be made publicly available unless the writer can demonstrate that the release of part or all of the information would not be in the public interest.  However, Council would be obliged to release information as required by court order or other specific law.
