How do I make a submission on the Planning Proposal?

    For written submissions: clearly mark your correspondence as a:

    "Submission to Planning Proposal PP-2021-7194 to amend Coffs Harbour Local Environmental Plan (LEP) 2013 to allow alterations to an existing pub and to use a vacant restaurant building as a drive-through bottle shop on land at 4/4A Bray Street, Coffs Harbour."

    Council is committed to openness and transparency in its decision-making processes. The Government Information (Public Access) Act 2009 requires Council to provide public access to information held unless there are overriding public interest considerations against disclosure.  Any submissions received will be made publicly available unless the writer can demonstrate that the release of part or all of the information would not be in the public interest.  However, Council would be obliged to release information as required by court order or other specific law.

    The intended outcomes of this planning proposal are to amend Coffs Harbour LEP 2013 to facilitate the use of a vacant restaurant building located on Lot 3 DP825181 as a "drive-through bottle shop" and make consequential alterations to the existing tavern on Lot 4 DP825181.

    What amendments are proposed to Coffs Harbour LEP 2013?

    Local Environmental Plans (LEPs) guide planning decisions for local government areas and are the main planning tool used to shape the future of communities and ensure local development is done appropriately.

    This proposed LEP amendment seeks to add a new item to Schedule 1 Additional Permitted Uses of Coffs Harbour LEP 2013, relating to Lots 3 & 4 DP825181, 4/4a Bray Street Coffs Harbour to permit a "pub" and amend the Additional Permitted Uses Map to specify the site on the map.

    Has the NSW Department of Planning and Environment endorsed these LEP Amendments for public exhibition?

    On 22 April 2022, the Minister for Planning and Homes determined pursuant to section 3.34(2) of the Environmental Planning and Assessment Act 1979 to issue a gateway determination for Planning Proposal PP-2021-7194 to allow it to be publicly exhibited. The Minister has agreed to condition the gateway determination to stipulate that Council is the local plan-making authority.     In accordance with the Minister’s determination and Council’s resolution, the Planning Proposal is now publicly available for community consultation.
