What are the objectives of the Planning Proposal?

    The objectives of the planning proposal are to:

    • amend Coffs Harbour LEP 2013 by changing the zoning of Lot 111 DP 730304 and the adjoining road reserve from Zone RU2 Rural Landscape to part Zone R1 General Residential and part Zone R2 Low Density Residential;
    • enable motel extensions to the existing tavern located on the northern part of Lot 111 DP 730304, along with a residential subdivision on the southern part of the property; and
    • ensure that the rezoning is consistent with the broad strategic direction for the locality as described by the North Coast Regional Plan 2036 and Council’s Local Growth Management Strategy (2020).

    What amendments have been endorsed for Coffs Harbour Local Environmental Plan 2013?

    Local Environmental Plans (LEPs) guide planning decisions for local government areas and are the main planning tool to shape the future of communities and ensure local development is done appropriately.

    Amendments to Coffs Harbour LEP 2013 were endorsed by Council on 28 May 2020 and related to the land use zone of Lot 111 DP 730304. The specific changes to the LEP are outlined in the planning proposal located in the document library on this web page, however broadly speaking the amendments will:
    • rezone Lot 111 DP 730304 from Zone RU2 Rural Landscape to part Zone R1 General Residential and part Zone R2 Low Density Residential, and
    • amend the relevant lot size map accordingly.

    What amendments have been approved for Coffs Harbour Development Control Plan 2015?

    A development control plan (DCP) provides detailed planning and design guidelines and associated mapping to support the planning controls in the Local Environmental Plan (LEP).

    It is necessary to amend maps contained within Coffs Harbour DCP 2015 to align with the endorsed LEP amendments contained in the planning proposal. Updates have been made to the density, front, side and rear setbacks maps contained within Coffs Harbour DCP 2015. The draft DCP mapping amendments can be viewed in the documents section of this web site.

    What did Council resolve at its Ordinary meeting on 28 May 2020?

    At the Ordinary meeting on 28 May 2020, Council resolved to:

    1. Endorse Planning Proposal PP_2019_COFFS_001_00 Tasman Street, Corindi Beach – Post Exhibition (Attachment 1).
    2. Delegate to the General Manager the authority issued by the NSW Department of Planning, Industry and Environment to exercise the functions of the Minister under Section 3.36 of the Environmental Planning and Assessment Act 1979 for the purposes of finalising Planning Proposal PP_2019_COFFS_001_00 Tasman Street, Corindi Beach - Post Exhibition.
    3. Continue to consult with the NSW Department of Planning, Industry and Environment on the terms of the amendment to Coffs Harbour Local Environmental Plan 2013, to ensure its consistency with the objectives, outcomes and provisions of Planning Proposal PP_2019_COFFS_001_00 Tasman Street, Corindi Beach - Post Exhibition.
    4. Approve Coffs Harbour Development Control Plan 2015 - Amendment No. 12 (7 Tasman Street, Corindi Beach) (Attachment 2), which will come into effect when public notice of Council’s decision is made in accordance with Part 3, Division 3 of the Environmental Planning and Assessment Regulation 2000.
    5. Inform those whom made a submission to Planning Proposal PP_2019_COFFS_001_00 Tasman Street, Corindi Beach and draft Coffs Harbour Development Control Plan 2015 Amendment Number 12 (7 Tasman Street, Corindi Beach), as well as affected landowners of Council’s decision.

    Does this mean that they can start to develop the land subject to the planning proposal?

    It is important to note that this decision does not approve any specific subdivision or development of the land. That will be subject to a separately lodged Development Application/s which will have to address the constraints that apply to the land.

    Issues raised by submissions were considered by technical officers within Council and summarised within the Council report for Council's consideration. Individual submissions were also (confidentially) attached to the Council report to ensure that Councillors were appropriately informed.
