How do I make a submission on the Planning Proposal and/or the draft Development Control Plan Mapping Amendments?

    For written submissions: clearly mark your correspondence as a:

    "Submission to:

    • Planning Proposal PP_2019_COFFS_004_00 to facilitate Lots 4 & 5 DP 41228, 75-77 & 81 Butlers Road Bonville, for large lot residential purposes; and/or 

    • Draft Coffs Harbour Development Control Plan 2015 – Amendment No 17 (Butlers Road Bonville)". 

    Written submissions should be addressed to the General Manager, Locked Bag 155, Coffs Harbour 2450, or emailed to coffs.council@chcc.nsw.gov.au and are to be submitted no later than close of business on Wednesday 22 July 2020.

    Council is committed to openness and transparency in its decision making processes. The Government Information (Public Access) Act 2009 requires Council to provide public access to information held unless there are overriding public interest considerations against disclosure. Any submissions received will be made publicly available unless the writer can demonstrate that the release of part or all of the information would not be in the public interest. However, Council would be obliged to release information as required by court order or other specific law.

    Written submissions must be accompanied, where relevant, by a “Disclosure Statement of Political Donations and Gifts” in accordance with the provisions of the Local Government and Planning Legislation Amendment (Political Donations) Act 2008 No. 44 Disclosure forms are available from Council’s Customer Service Section or on Council’s website www.coffsharbour.nsw.gov.au/disclosurestatement(External link).

    What is the objective of the Planning Proposal?

    The objective of this planning proposal is to amend Coffs Harbour LEP 2013 to permit large lot residential development on the subject land, having regard to the environmental constraints affecting the land.

    What amendments are proposed for Local Environmental Plan 2013?

    The intended outcomes of the planning proposal will be achieved by amending the following Coffs Harbour LEP 2013 maps:

    • Coffs Harbour Land Zoning Map (Sheet LZN_006) over 75-77 & 81 Butlers Road, Bonville - Lot 4 & 5 DP 41228 to change land currently zoned RU2 Rural Landscape to part Zone R5 Large Lot Residential and part Zone E2 Environmental Conservation;
    • Coffs Harbour Minimum Lot Size Map (Sheet LSZ_006) over 75-77 & 81 Butlers Road, Bonville - Lot  4  &5  DP  41228  to change  those  parts  of  the  land  proposed  to  be  zoned  R5  and currently subject to minimum lot size provision AB – 40ha to Y – 1 hectare; and
    • Coffs Harbour Terrestrial Biodiversity Map (Sheet CL2_006) over 75-77 & 81 Butlers Road,
      Bonville - Lot 4 &5 DP 41228 to include areas proposed to be zoned E2 Environmental Conservation as terrestrial biodiversity on the map.

    What mapping amendments are proposed for Development Control Plan 2015?

    A development control plan (DCP) provides detailed planning and design guidelines and associated mapping to support the planning controls in the Local Environmental Plan (LEP).

    It is necessary to amend maps contained within Coffs Harbour DCP 2015 to align with the proposed LEP amendments contained in this planning proposal. Updates will be made to the front, side and rear setbacks maps, as well as the preservation of vegetation maps contained within Coffs Harbour DCP 2015. The draft DCP mapping amendments can be viewed in the "Document Library" section of this web page.

    Has the NSW Department of Planning and Environment endorsed these LEP Amendments for public exhibition?

    On 22 January 2020, the Minister for Planning and Public Spaces determined pursuant to section 3.34(2) of the Environmental Planning and Assessment Act 1979  to issue a Gateway determination for Planning Proposal PP_2019_COFFS_004_00 and authorised Coffs Harbour City Council to exercise its delegation to make the Plan. In accordance with the Minister’s determination and Council’s resolution, the planning proposal is now publicly available for community consultation.
